Andrew Higgs
Andrew is an experienced commercial litigator, specialising in dispute resolution, arbitration, mediation, insurance and legal risk management; both in the City of London (Commercial & Admiralty Courts), and also internationally.
Andrew joined Setfords in March 2017, having practiced with a leading City of London law firm for more than 30 years, and as a partner for more than 20 years. More recently, he worked as the Liaison Officer and legal risk management consultant for the International Union of Marine Insurance (“IUMI”), at the International Maritime Organisation (“IMO”), for five years (2008-2013), one of the original Non-Government Organisations invited to join the only UN Agency in the British Isles, when it was first formed in Westminster, in 1948.
Patrick Oliver
Patrick joined the Setfords team in 2015 having previously been a Senior Associate and departmental head at a south coast firm.
Claims handling/risk assessment in a maritime context- Patrick and his team work closely with several of the International Group of Protection and Indemnity Clubs and their insured offering a comprehensive claims handling service for personal injury claims including all litigation services. He and the team deal with passenger and crew injuries ranging from slipping/tripping accidents and sickness claims (norovirus, food poisoning) through to serious burns, head and spinal injuries as well as inquests. Cases usually have an international dimension and include injuries sustained on a range of merchant vessels as well as private yachts. Clients appreciate Patrick’s ‘no nonsense’ commercial approach to litigation.
Nina Hall
Nina is an experienced Advocate, accredited Mediator and sits as an Arbitrator.
She is a specialist in cross-border trade and investment (contracting, project management & dispute resolution) and represents national and international clients. Nina has experience of litigation at all levels of the Courts of England and Wales as well as before international tribunals (ICC,ICSID,UNCITRAL and other regional and local regulatory and trade association tribunals).
Nina was involved in the growth of the litigation funding market and has extensive experience of case management (Multi-Jurisdictional, Mass Claims). She has worked for international firms and clients (Oil & Gas, Investment Due Diligence, Banking Regulatory, Liquidations, Debt Recovery & Serious Fraud). Nina is a firm believer in rapid low cost dispute resolution but is prepared to dig her heels in where the client’s best interests are served by a strong stance.
Simon Daniels
Dr Simon Daniels qualified as a Solicitor in 1985, since then he has particularly specialised in criminal and marine litigation, before he developed a career in alternative dispute resolution as a Qualified Dispute Resolver and Member of the Faculty of Mediation and ADR, founded by the Academy of Experts in London, in furtherance of one of the Academy’s principal objectives, the pursuit of cost-efficient dispute resolution.
Simon brought his professional background to the academic field at Solent University, where he managed the law and business parts of the MCA-accredited Merchant Vessel Operations programme at Warsash Maritime Academy, one of the world’s leading centres of excellence in training for merchant shipping professionals. At the centre of the undergraduate provision, he was Couse Leader of the BSc (Hons) Degree course in Marine Operations Management, which led to a Collaborative Partnership in Hong Kong, in which he was involved both in the management and the delivery. During his University career, Simon was involved with specialist advice in a number of criminal cases, including the trial of a Watchkeeper for manslaughter and a jet ski rider under S58 Merchant Shipping Act 1995.
He has a particular interest in the field of the criminalisation of the Ship’s Master, which harnesses his professional career to his background in the Maritime Industry and, in 2012, was awarded a PhD for his thesis: The Criminalisation of the Ship’s Master. A new approach for the new millennium. In 2014 Simon developed his background in civil aviation, when he briefed an international conference hosted by Eurocontrol and the Dutch Government on criminal negligence in matters arising out of the MH17 incident. He has published a number of academic papers and, in 2016, wrote Corporate Manslaughter in the Maritime and Aviation Industries (Informa Law from Routledge, ISBN 978-1-138-92047-7).

Andrew was the appointed Liaison Officer, observer and rapporteur for IUMI @IMO for five years, after the financial crash of 2007/8.
IUMI was one of the original six Non-Government Organisations at IMO in 1948/1958, which is the only UN Agency in the British Isles, and represents marine (re)insurers [and their US$ 35+ billion annual turnover, where IUMI is the only NGO which represents financial services community @IMO.]
He dealt with such politically-sensitive issues as Piracy and Armed Robbery in the Indian Ocean and Arabian Sea, Guidelines for Privately-Contracted Armed Security Guards aboard merchant ships, UN/EU Sanctions, the amendments to SOLAS required to improve weighing of cargo containers prior to loading in Cargo Container Ships in ports and harbours world-wide, and the IMO SOLAS review of Passenger Ships post the M/S “COSTA CONCORDIA” casualty, in January 2012.
Moray Hughes and Andrew Higgs have acted for insurers and insureds on various Marine and Non-Marine (Re) insurance matters; both domestically and internationally; including hull & machinery, cargo, liability, kidnap and ransom, professional indemnity and political risks.

Sue has acted for a member of the Major Ports Group in relation to Commercial leases and licenses across the dock estate and for tenants of a vehicle handling compound. She also acted for Harbour Commissioners in the grant of a Regulating lease of a river from the Crown Estate.

Susan Macpherson has acted for four marina-owning clients in relation to the acquisition and development of their properties in some 32 sites, both in the UK and in Europe. Her work has been recognised by her clients as being first class.

Latest example: Purchase of a Marina in Glasgow for James Watt Marina Limited
In 2017, Susan project managed the legal work in conjunction with Scottish lawyers relating to the Purchase of a Marina business with a Development lease at James Watt Dock from Landlord James Watt Dock LLP. The right to purchase the site came as the result of a Competitive Tender process and completion within 4 weeks. This involved negotiation of a long lease and purchase of the business as a going concern.
Public International Law involves all aspects of National, Regional and International Shipping Regulation, Safety and Compliance, including Marine Pollution.
Andrew Higgs was invited by the Committee Chairman to participate in this Maritime UK Working Group in January 2016, and has been one of a small group of BMLA Lawyers actively participating in the regular meetings. He has recently suggested editorial amendments from a legal and regulatory view to the first published version of the Code of Practice, where a Second Iteration is due to be published in the summer of 2018. This is a World-leading, thought Leadership Protocol Document of UK so-called “Soft Law” Guidelines for “Small Ships” of less than 24 metres Length Over All.
He spoke at the National Oceanographic Centre in Southampton on the insurance implications of US/MASS in November 2016, and then was invited by The Greenwich Forum to speak in the House of Commons on the legal implications of US/MASS, in January 2017.
He was one of the editors of the UK-led paper presented to MSC @IMO [“MSC98/20/2”], which first proposed that US/MASS be on the IMO agenda, and attended the LEGAL Committee meeting at IMO at the invitation of IFSMA in April 2018, where the legal issues raised by US/MASS were discussed at IMO for the first time, and where CMI presented a key IMO Information Paper [“LEG 105/11”].
Moray Hughes has acted in various matters involving marine pollution and has acted for shipping interests in the defence of marine pollution prosecutions.
